1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the website https://skylinkconnect.co.za/ (the “Site”) and any purchase of products or services from Sky Link Connect (“Sky Link Connect”, “we”, “us”, or “our”). By browsing, registering an account, or placing an order you confirm that you have read, understood, and agree to be bound by these Terms and any policies referenced herein.

2. Definitions

“Business day” means any day other than a Saturday, Sunday, or public holiday in South Africa. “Consumer Protection Act” means the South African Consumer Protection Act 68 of 2008 (“CPA”). “POPIA” means the Protection of Personal Information Act 4 of 2013. “Product” means any goods or services offered on the Site.

3. Eligibility & Account Security

You must be at least 18 years old or the age of majority in your jurisdiction (whichever is higher) to create an account or place an order. You are responsible for keeping your login credentials confidential and for all activities that occur under your account. Notify us immediately of any unauthorised use.

4. Use of the Site

You agree not to use the Site for any unlawful purpose or in a way that infringes the rights of others, restricts or inhibits anyone else’s use of the Site, or could damage, disable, overburden, or impair our servers or networks. All content on the Site, including text, graphics, logos and trademarks, is owned by or licensed to SkyLinkConnect and is protected by intellectual‑property laws. You may view, download, and print portions of the Site for personal, non‑commercial use only.

5. Products, Pricing & Availability

All prices are shown in South African Rand (ZAR) and include VAT unless stated otherwise. While we take every care to ensure prices and product information are correct, errors may occur. If we discover an error in the price or description of a Product you have ordered we will inform you and give you the option of reconfirming the order at the correct price/description or cancelling it. Stock availability shown on the Site is an estimate only.

6. Orders & Contract Formation

After you place an order you will receive an email acknowledging that we have received it (“Order Confirmation”). A binding contract is formed only when we dispatch the Products and send you a dispatch confirmation. We reserve the right to decline or cancel an order for any legitimate reason including suspected fraud, inability to authorise payment, or stock unavailability. Payment must be received in full before dispatch.

7. Payment

We accept secure online payments via recognised payment gateways (credit/debit card, instant EFT, etc.). Payment card details are processed by the payment processor and are not stored on SkyLinkConnect servers. By submitting a payment you warrant you are authorised to use the chosen payment method.

8. Delivery

Delivery terms, options, costs, and risk transfer are set out in our Shipping Policy (incorporated by reference). Risk in the Products passes to you on delivery. Title passes only once we have received cleared payment in full.

9. Returns & Refunds

Our Returns Policy (incorporated by reference) explains your rights to return Products, including your statutory rights under the CPA and ECT Act cooling‑off period.

10. Warranty & Consumer Guarantees

Products carry the manufacturer’s warranty (where applicable) in addition to your statutory rights. Nothing in these Terms diminishes your rights under the CPA to receive goods that are of acceptable quality, fit for purpose, and free from defects.

11. Limitation of Liability

To the maximum extent permitted by law, SkyLinkConnect will not be liable for any indirect, special, incidental, or consequential losses arising from your use of the Site or purchase of Products. Our total liability for any direct loss shall not exceed the purchase price of the Product giving rise to the claim. Nothing in these Terms limits liability for death, personal injury, gross negligence, or any matter that cannot legally be limited.

12. Indemnity

You agree to indemnify and hold SkyLinkConnect harmless from any claim, demand, loss, or damage (including reasonable legal fees) arising from your breach of these Terms or your violation of any law or third‑party rights.

13. Force Majeure

We are not responsible for failure to perform or delay in performance caused by circumstances beyond our reasonable control, including acts of God, strikes, epidemics, or disruption of transportation or utilities.

14. Governing Law & Dispute Resolution

These Terms are governed by South African law. In the event of a dispute we encourage you to contact us to seek an amicable resolution. If unresolved, you consent to the non‑exclusive jurisdiction of the South African courts.

15. Changes to Terms

We may update these Terms from time to time. The revised version will be posted on the Site and will take effect on the date of posting. Continued use of the Site after changes constitutes acceptance of the updated Terms.
